Sales and use tax: Supreme Court overrules physical presence requirement
There was big news in the sales tax world recently. The Supreme Court decided in favor of South Dakota in the South Dakota v. Wayfair case.
The court has decided physical presence is no longer necessary to create sales tax nexus and it opens the door for South Dakota and other states to use economic nexus thresholds such as South Dakota’s $100,000 in sales or 200 transaction threshold to assert sales tax nexus.
